1. You may only return an item in the following circumstances:
- (a) The goods have been misdescribed; or
- (b) The goods are faulty.
2. If an item or lot is described in the lot description on the Mechle.com website as being in a faulty or damaged condition, you acknowledge such condition when bidding for that lot or item, and further acknowledge that Mechle.com accepts no liability for, and will not entertain any subsequent claim for any loss or damage incurred by a you on account of the faulty or otherwise damaged condition of the auction item or lot.
3. If you wish to return an item, you must email the Mechle.com customer service team with full details of your purchase and the reason for the return of the item. Upon receipt of your email, Mechle.com will email you a return of goods request form, which must be included with the returned item.
4. The goods must be returned to Mechle.com in the same condition as the goods were received by you. The goods must be returned to Mechle.com by registered post and signed for by Mechle.com acknowledging receipt or by a courier at your sole expense. You must maintain at your cost sufficient insurance to cover any damage that may occur in transit or otherwise.
5. Prior to the return of any large items (eg furniture, tables etc), you should contact Mechle.com to arrange the return of the goods through a suitable transport company. The costs of arranging the return of such goods are at your sole expense.
6. Items may not be returned to us in circumstances where you attend personally or through a representative at our showroom and take delivery of the item (s). In these circumstances, inspection of the goods is freely available (and highly recommended) all items which are sold and collected will be on an “as-is where-is” basis.
7. The right to return items expires 10 business days after delivery of the item to you unless prior arrangement has been made with Mechle.com and confirmed in writing. Customers are advised to save their delivery note.
8. The Trade Practices Act (Australia), and the laws of some States and territories, may give you the benefit of certain statutory warranties regarding the return of goods which cannot be excluded by contract.
9. Subject to any rights as may be afforded to you under any State or Commonwealth law, if an item is sold in an online auction, and that item is sold with an accompanying manufacturer’s warranty, Mechle.com will take no responsibility whatsoever for the content, fulfilment or enforcement of that manufacturer’s warranty, and it shall be your responsibility at all times to contact any such manufacturer in relation to all queries and claims relating to the manufacturer’s warranty.
10. If Mechle.com emails you a returns advice form in accordance with paragraph 2 and Mechle.com does not receive a response from you or receive the returned item from you within 5 business days thereafter (or otherwise by prior written arrangement between Mechle.com and you), you shall be deemed to have waived any right that you may have had to return the item and shall thereafter have no further right to return the item to Mechle.com, or claim a refund.
11. Within the first 10 business days of receipt by Mechle.com of a returned item, the item will be inspected and tested (as the case may be) to determine its condition and, if the item is found to be in good working order (and your claim as to the faulty nature of the item is found to be invalid), the item will be returned to you and you will be charged all freight charges incurred by Mechle.com in relation to the re-return of the goods. Mechle.com shall have the right, and you hereby authorise Mechle.com to charge your credit card with any moneys incurred by Mechle.com in this regard.
12. If, upon receipt by Mechle.com of a returned item and subsequent determination by Mechle.com that the item is faulty or damaged or incorrectly described Mechle.com will, within 21 business days refund your credit card for the invoice amount.
13. Despite any other provision herein, Mechle.com has the absolute discretion to make a determination regarding the Returns Policy.
